Συγκεκριμένα η πλειονότητα των εγκαταστάσεων έγινε πριν την κατάργηση του Κεφ. 305 (που έγινε το Δεκέμβριο του 2003) που με το Άρθρο 7 επέτρεπε στην ΑΤΗΚ να εισέρχεται σε δημόσιους και ιδιωτικούς χώρους για να προβαίνει σε εργασίες ή να τοποθετεί στύλους και εξοπλισμό και πριν την κατάργηση των αντίστοιχων προνοιών του Κεφ. 302 που επέτρεπε ειδικά στην ΑΤΗΚ να προβαίνει σε τέτοιες ενέργειες. Με την αλλαγή της νομοθεσίας η ΑΤΗΚ έχει προβεί σε εγκαταστάσεις για τις οποίες δεν απαιτείται πολεοδομική άδεια σύμφωνα με το διάταγμα Κ.Δ.Π. 859/2003. Για τις εγκαταστάσεις που δεν καλύπτονται από το εν λόγω διάταγμα η ΑΤΗΚ έχει υποβάλει σχετικές αιτήσεις για εξασφάλιση πολεοδομικής άδειας. Επιπρόσθετα, από τον Οκτώβριο του 2004 που έχει ληφθεί η απόφαση για καθορισμό χωροθετικής πολιτικής για τους σταθμούς βάσης η ΑΤΗΚ δεν έχει προβεί σε νέες εγκαταστάσεις εν αναμονή της ολοκλήρωσης της χωροθετικής πολιτικής υποβάλλοντας αιτήσεις για πολεοδομικές και οικοδομικές άδειες. Η ΑΤΗΚ συμφωνεί για την αναγκαιότητα καθορισμού χωροθετικής πολιτικής ανάπτυξης σταθμών κινητής τηλεφωνίας στη βάση των πρακτικών που εφαρμόζονται στα κράτη μέλη της Ευρωπαϊκής Ένωσης, ώστε να διασφαλίζει αφενός την προστασία του περιβάλλοντος και του κοινού και αφετέρου την ομαλή ανάπτυξη των δικτύων κινητής τηλεφωνίας. Για το λόγο αυτό έχει κάνει επαφές με τις αρμόδιες αρχές του κράτους δίνοντας πληροφορίες σχετικά με το θέμα αλλά και υποβάλλοντας συγκεκριμένες προτάσεις. The recommended offer, at US$3.85 per share (translating into US$19.25 per Global Depositary Share (“GDS”)) will be an all cash offer, with shareholders also being given a cash and share alternative.
